Welcome to Kawaii Logo Generator by Markury! These Terms of Service ("Terms") govern your use of the Kawaii Logo Generator website and service (the "Service"). By using the Service, you agree to these Terms. If you disagree with any part of these Terms, please do not use our Service.

1. Service Description

Kawaii Logo Generator is a web application that uses AI to create kawaii-style logos based on user prompts. When you use our Service:

  • You submit text prompts through our interface
  • We process your prompts using AI technology
  • You receive generated images as JPG files Important Limitations:
  • Generated image URLs expire after approximately 6 hours
  • Images are not permanently stored on our servers
  • You must download any images you wish to keep

2. User Accounts

Account Creation and Authentication

  • You must create an account to use our Service
  • Authentication is through Discord or Google
  • We do not store passwords or implement direct authentication

Account Information

We collect minimal user data:

  • Name
  • Email address
  • Profile picture URL This information is used for display purposes and to associate your usage data with your account.

3. Usage Tiers and Limitations

Free Tier

  • 3 prompts (12 images) per day
  • Resets at midnight UTC
  • Non-commercial license for all generated images

Paid Boost

  • $10 for 25 prompts (100 images)
  • Commercial license for all generated images
  • Expires after 90 days OR when all 25 prompts are used, whichever comes first
  • Only one active boost allowed per user at any time

Technical Enforcement

  • Usage limits are enforced automatically
  • Attempting to circumvent limitations is prohibited and may result in account termination

4. Licensing Terms

Free Tier License

  • Images generated under the free tier are for NON-COMMERCIAL USE ONLY
  • Personal use, educational purposes, and non-profit activities are permitted
  • Using free tier images for any commercial purpose is prohibited

Paid Boost License

  • Images generated while a boost is active may be used for COMMERCIAL PURPOSES
  • Commercial license is perpetual and worldwide
  • Commercial license applies only to images created while the boost is active

License Conditions (All Tiers)

  • You are granted a license to use the generated images according to your tier
  • You may not claim exclusive ownership of the AI-generated elements themselves
  • You may not register trademarks or copyright for the raw, unmodified AI-generated images
  • You may use the images as elements in larger works that may be eligible for intellectual property protection
  • The licensing rights are provided by us as the creator of the custom model that enables the specific kawaii logo style

5. Prohibited Uses

You agree not to use the Service:

  • To generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • For automated scraping or bulk requests
  • To intentionally overload or damage the Service infrastructure
  • To share accounts to circumvent usage limits
  • To reverse engineer or attempt to extract the code of our Service
  • To generate content that infringes on intellectual property rights
  • To attempt prompt injection, jailbreaking, or otherwise circumventing the intended use of the AI models
  • To use custom inputs, system prompts, or external models in a manner inconsistent with the Service's purpose of generating kawaii logos
  • To submit chargebacks or payment disputes for properly delivered services
  • To exploit technical loopholes or bugs
  • To abuse our technical support or error rectification policies Any violation of these prohibitions may result in immediate termination of your account, permanent ban from the Service, and potential legal action.

6. Payment Terms

Boost Purchases

  • Boosts are one-time purchases, not subscriptions
  • Only one boost can be active per user at any time
  • Boosts are non-transferable between accounts
  • Boosts cannot be paused, extended, or partially refunded
  • Unused portions of boosts expire after 90 days
  • Boosts are not credits and have no cash value
  • All sales are final - no refunds under any circumstances
  • By purchasing a boost, you acknowledge and agree that you are buying a limited license for a specific duration (90 days maximum) or until usage limits are reached

Payment Processing

  • We use secure third-party payment processors
  • We do not store your payment information on our servers
  • All payments are final and non-refundable
  • No refunds will be provided for subjective dissatisfaction with generated images
  • No refunds will be provided for failure to download images before their expiration
  • Disputing valid charges or initiating chargebacks for properly delivered services constitutes a violation of these Terms and may result in account termination
  • You agree not to dispute charges for Boosts that have been properly delivered, even if you choose not to use them fully before expiration

7. Intellectual Property

Your Rights

  • You receive usage rights to images you generate, subject to the applicable license tier
  • We do not retain copies of generated images on our servers
  • We do not claim ownership of your prompts

Model Development and Ethics

  • The kawaii logo generation capability of this Service is powered by a custom adapter model that was developed ethically
  • This adapter was trained exclusively on artwork that was:
    • Created by the operator
    • Properly licensed for AI training
    • Commissioned from artists who explicitly consented to AI training usage
  • While the style is inspired by the kawaii aesthetic popular in digital art, we took specific measures to exclude unauthorized works
  • We respect artists' rights and have made good faith efforts to avoid training on works from artists who have expressed opposition to AI training

Our Rights

  • We retain all rights to the Service, including its design, code, and features
  • The base AI models are licensed through inference providers, while we own the custom adapter
  • You receive a license to use the generated images according to your tier, not rights to the underlying AI models

8. Disclaimers and Limitations

Service Availability

  • The Service is provided on an "as is" and "as available" basis
  • We do not guarantee uninterrupted, secure, or error-free service
  • We reserve the right to suspend or terminate the Service at any time

Content Limitations

  • AI image generation has inherent limitations and may produce unexpected results
  • Results depend on the prompt, AI model version, and random factors
  • We do not guarantee specific aesthetic outcomes or perfect adherence to prompts
  • The AI is inherently stochastic (random) and will produce different results each time
  • Text rendering, spelling, and certain visual elements may be imperfect or incorrect
  • You accept full responsibility for all outputs generated using your prompts
  • No refunds will be provided for outputs that don't meet your subjective expectations
  • You acknowledge that our custom kawaii style adapter may reduce certain capabilities of the base model, including text rendering fidelity, in exchange for improved stylistic consistency

Image Preservation

  • Generated image URLs expire after approximately 6 hours
  • You are responsible for downloading and preserving images you wish to keep
  • We are not responsible for lost images that were not downloaded

9. Liability Limitations

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims relating to these Terms or the Service shall not exceed the amount you paid to us (if any) in the past 12 months
  • We are not liable for lost profits, data loss, or business interruption
  • We are not responsible for any content generated by the AI based on your prompts
  • We are not liable for lost images due to browser navigation, closing tabs, or failure to download before expiration
  • We provide no warranty or guarantee regarding the quality, accuracy, or suitability of generated images for any purpose
  • You agree to hold us harmless from any claims arising from your use of the Service
  • You understand and agree that all risk associated with using the Service rests solely with you
  • In jurisdictions where exclusion of liability is restricted, our liability is limited to the maximum extent permitted by law

Technical Errors and Remedies

  • We may, at our sole discretion, restore prompts or image usage in cases of technical errors within our control
  • Any determination of what constitutes a technical error is made solely by us
  • Abuse of our error remediation policy will result in account termination
  • We are not responsible for technical issues beyond our control, including but not limited to internet connectivity issues, browser compatibility, or third-party service failures

10. Modifications to Service and Terms

Service Changes

  • We may modify or discontinue the Service at any time
  • We are not liable to you or any third party for any modification or discontinuation

Terms Updates

  • We may update these Terms at any time
  • Updated Terms will be posted on our website
  • Your continued use of the Service after changes constitutes acceptance of the updated Terms

11. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violations of these Terms
  • Actions that may create liability for us
  • At our sole discretion for any reason Upon termination:
  • Your right to use the Service will immediately cease
  • Any active boosts will be forfeited
  • We may delete your account information and usage history

12. General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with the laws of New York State, United States, without regard to its conflict of law principles.

Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved through the courts of New York State.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service.
